Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the Tour Marketing Hub platform (“Service”), operated by Kanchan Kanya Signature Holidays LLP (“Company”, “we”, “us”, or “our”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Description of Service

Tour Marketing Hub is a multi-tenant software-as-a-service platform that enables travel agencies, tour operators, and hospitality businesses to generate AI-powered marketing content, manage assets, and publish to connected social channels including Google Business Profile and Meta platforms. Features, availability, and pricing tiers may change over time.

3. Eligibility and Accounts

You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or breach of security.

4. Workspaces and Multi-Tenancy

The Service is organized into workspaces (tenants). Each workspace is a logically separate environment. Workspace owners and administrators control access, roles, and permissions for team members. You may only access workspaces you have been invited to or created yourself. You may not attempt to access or interfere with other tenants’ data.

5. User Content and Data

You retain ownership of the content, business data, and marketing materials you upload or generate through the Service (“User Content”). By using the Service, you grant us a limited license to process, store, and transmit your User Content solely for the purpose of providing and improving the Service. You represent that you have all necessary rights to your User Content and that it does not violate any applicable law or third-party rights.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights.
• Transmit malware, spam, or unsolicited communications.
• Attempt to gain unauthorized access to the Service, other accounts, or connected systems.
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
• Reverse engineer, decompile, or extract source code from the Service.
• Use the Service to generate or distribute misleading, fraudulent, or harmful content.

We reserve the right to suspend or terminate accounts that violate these rules.

7. Intellectual Property

All intellectual property rights in the Service, including software, designs, trademarks, and documentation, belong to Kanchan Kanya Signature Holidays LLP or its licensors. These Terms do not grant you any rights to our trademarks, logos, or service marks except as necessary to use the Service in accordance with these Terms.

8. Payments and Subscriptions

Certain features of the Service may require payment. Payments are processed via Razorpay. By subscribing, you agree to pay all applicable fees and taxes. Subscriptions may renew automatically unless cancelled before the renewal date. Refunds are handled in accordance with our refund policy and applicable law.

We may change pricing or subscription terms by providing notice in advance. Your continued use after the change constitutes acceptance.

9. Third-Party Integrations

The Service integrates with third-party platforms including Google, Meta, and Razorpay. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or policies of third-party services, and we do not guarantee that integrations will function without interruption.

10. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

11. Limitation of Liability

To the maximum extent permitted by law, Kanchan Kanya Signature Holidays LLP and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or relating to your use of or inability to use the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim, or INR 5,000 if no payment was made.

12. Indemnification

You agree to indemnify and hold harmless Kanchan Kanya Signature Holidays LLP and its affiliates from any claims, damages, liabilities, costs, or expenses arising out of your use of the Service, your User Content, or your violation of these Terms.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, fail to pay fees when due, or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our Privacy Policy and applicable law.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal, India. Before initiating litigation, the parties agree to attempt to resolve disputes informally.

15. Changes to Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a revised effective date. Material changes will be communicated via email or through the Service. Your continued use after the effective date of changes constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
